01Agreement
These Terms & Conditions ("Terms") are an agreement between GrowthNode ("we," "us," "our") and the person or business purchasing our website services ("you," "Client").
By checking the agreement box on our payment page, or by paying any amount to us, you confirm that you have read and agree to these Terms. If you are purchasing for a business, you confirm that you are authorized to agree on its behalf.
02Website Setup ($300 one-time)
The Website Setup Fee is a one-time payment of $300, due before we launch your website. It covers:
- Design and build of the website as shown in the preview you approved
- Mobile-friendly layout
- Basic search engine setup (page titles, descriptions and structure)
- Contact or lead forms
- Connecting your domain and installing an SSL certificate
- Launching the website live
The setup fee does not include the cost of your domain name, paid third-party software, stock photos, logo design, copywriting beyond the approved preview, or new pages and features added after you approve the preview. We will quote any additional work in writing before starting it.
We aim to launch within 2 business days after payment, provided you have given us access to your domain and any information we need.
03Maintenance Plan ($150 per month)
The Maintenance Fee is $150 per month and keeps your website online and up to date. It includes:
- Website hosting and SSL certificate
- Software and security updates
- Regular backups
- Uptime monitoring, with repairs when the site goes down
- Up to 2 content edit requests per month (text, photos, hours, prices and similar small changes)
- Support by email or phone during business hours
Unused edit requests do not roll over to the next month. Larger changes, such as new pages, redesigns or new features, are not included and will be quoted separately.
We will usually complete edit requests within 3 business days.
04Payment and Automatic Renewal
Your maintenance plan renews automatically every month until you cancel. By agreeing to these Terms, you authorize us to charge the card or payment method you provide:
Payments are processed securely by Stripe. We do not see or store your full card number. You will receive an email receipt for each charge.
Failed payments. If a payment fails, we will notify you and retry the charge. If the balance is not paid within 14 days, we may pause maintenance services or take the website offline until the account is current.
Price changes. We will give you at least 30 days' written notice before any change to the monthly fee. If you do not agree to the new price, you may cancel before it takes effect.
Prices do not include any sales tax that may apply. If tax applies, it will be shown at checkout.
05Cancellation and Refunds
Notice period. Cancellation takes effect 30 days after we receive your request. If a monthly charge falls within those 30 days, it will be billed as normal, and no charges will be made after that.
Setup fee. The $300 Website Setup Fee is non-refundable once we begin launch work, because it pays for work already completed.
Maintenance fees. Monthly fees already paid are non-refundable, and we do not give partial-month refunds.
Mistakes. If we charge you in error, contact us and we will refund the incorrect amount.
06Your Responsibilities
You agree to:
- Give us accurate business information and timely access to your domain account
- Provide only text, images, logos and other content that you own or have permission to use
- Review the website and tell us about any errors you find
- Keep your contact and payment information up to date
You are responsible for the content you provide and for making sure your business information, claims and offers on the website are accurate and lawful. We are not responsible for delays caused by missing information or access.
07Ownership
What you own. You own your domain name, your business name and logo, and all text, photos and other content you provide.
What GrowthNode owns. GrowthNode owns the website, including its design, layout, code, templates, pages and the platform account it runs on, both during and after your plan. Paying the setup fee and maintenance fees gives you the right to use the website while your maintenance plan is active. It does not transfer ownership of the website to you.
If you cancel. When your cancellation takes effect, your right to use the website ends and the website stays the property of GrowthNode. We will take it offline and release your domain so you can point it elsewhere. You may not copy, rebuild or reuse the website's design or code elsewhere without our written permission. On request within 30 days, we will send you a copy of the text and images you provided.
08Hosting and Third-Party Services
Your website relies on third-party providers, including our hosting platform, Stripe, and your domain registrar. We work to keep your site online, but we do not guarantee uninterrupted service. Occasional downtime may happen because of maintenance, outages or events outside our control.
We are not responsible for failures, price changes or policy changes by third-party providers. If a provider change affects your website, we will let you know and work with you on a solution.
09No Guarantee of Results; Limit of Liability
We will perform our services in a professional manner. We do not guarantee any specific search ranking, number of visitors, leads or sales.
Except as stated in these Terms, our services are provided "as is," without other warranties of any kind, to the extent the law allows.
To the fullest extent the law allows, we are not liable for lost profits, lost data, lost business or other indirect or consequential damages. Our total liability for any claim is limited to the amount you paid us in the 3 months before the claim arose.
10Other Terms
Indemnification. You agree to cover our reasonable costs, including legal fees, if a third party makes a claim against us because of content you provided or how you use the website.
Ending service. We may end this agreement with 30 days' written notice, or right away if you fail to pay, use the website for unlawful purposes, or treat our team abusively. If we end the agreement without cause, we will refund any maintenance fee paid for time after service ends.
Governing law. These Terms are governed by the laws of the State of Arizona. Any dispute will be handled in the state or federal courts located in Maricopa County, Arizona, unless the law where you live requires otherwise.
Changes to these Terms. We may update these Terms. We will email you at least 30 days before changes take effect. Continuing your plan after that date means you accept the updated Terms.
Entire agreement. These Terms, together with your approved website preview and any written quote we send you, are the full agreement between us. If any part of these Terms is found unenforceable, the rest stays in effect.
